Joint guidance to state and local child welfare agencies and courts on the requirements of Title II of the Americans with Disabilities Act (ADA) and Section 504 of the Rehabilitation Act

Today the U. S. Department of Justice’s Civil Rights Division together with the U. S. Department of Health and Human Services’ Office of Civil Rights and Administration for Children and Families issued joint technical assistance about the applicability of Title II of the Americans with Disabilities Act and Section 504 of the Rehabilitation Act to the administration of child welfare programs, activities, and services. This technical assistance includes a cover letter to stakeholders and an explanatory document that contains a question and answer section. This technical assistance is intended to help child welfare agencies and family courts understand their obligations under Federal law to ensure that parents and prospective parents with disabilities receive equal treatment and equal access to parenting opportunities.
